Privacy Policy | Terms of Service
This Referral Agreement (“Agreement”) is made between Empower Tax & Financial Services (“Company”) and the individual submitting the referral application (“Referrer”). By signing up to participate in the Company’s Referral Program, the Referrer agrees to the following terms:
1. PurposeThe purpose of this Agreement is to outline the terms under which the Referrer may refer potential clients to the Company for tax preparation and related services.
2. Independent StatusThe Referrer is an independent participant in this program and is not an employee, contractor, partner, or representative of the Company. Nothing in this Agreement creates an employment relationship or partnership between the parties.
3. Referral ProcessThe Referrer may share their unique referral link or code with potential clients. When a referred client completes tax preparation with the Company, the Referrer becomes eligible for a referral payout in accordance with this Agreement.
4. CompensationPayouts are made only after the referred client has paid in full for services rendered. The standard referral payout amount is as agreed at the time of this agreement per qualified client, unless otherwise stated in writing.Payments will be issued via the payment method selected by the Referrer and paid weekly.
5. Tax ObligationsIf the Referrer earns $600 or more in referral payouts during the calendar year, a Form 1099-NEC will be issued, and the Referrer must provide a completed W-9 form to the Company. The Referrer is solely responsible for reporting and paying any applicable taxes on income received.
6. Marketing GuidelinesThe Referrer agrees to represent the Company in a professional manner. Misleading statements, false claims, or unauthorized promotions using the Company’s name, logo, or materials are prohibited. Any violation may result in immediate removal from the program and forfeiture of unpaid commissions.
7. ConfidentialityThe Referrer agrees to keep all non-public information, including client data and internal business processes, confidential. Client information obtained through referrals may not be shared, sold, or used for any other purpose.
8. TerminationThe Company reserves the right to terminate this Agreement and the Referrer’s participation in the program at any time, with or without cause. Any unpaid commissions earned prior to termination will be paid according to this Agreement’s payout policy.
9. ModificationsThe Company may update or modify the Referral Program, including payout structure and terms, at any time. Notice of significant changes will be provided via email or posted on the Company’s website.
10. Governing LawThis Agreement is governed by and interpreted under the laws of the State of South Carolina.
11. AcceptanceBy submitting the referral sign-up form or continuing to refer clients after receiving notice of these terms, the Referrer acknowledges and agrees to be bound by this Agreement.
